01 Acceptance of Terms

By using The Secretary, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must immediately stop using the Service and remove the Bot from any servers you control.

These Terms apply to all users of the Service, including server administrators who configure the Bot and regular members who interact with its features.

02 Description of Service

The Secretary is a Discord automation, moderation, utility, roleplay, and server-management bot with an optional /ask AI utility. The Service includes, but is not limited to:

• Information commands, bot links, support links, help menus, aliases, prefix support, ping/latency checks, and server/member information.
• Moderation and safety tools, including AutoMod, ping prevention, ghost-ping detection, purge, lock/unlock, slowmode, nickname tools, blacklists, ban/kick/timeout helpers, logs, and cleanup.
• Role and member-management systems, including autorole, reaction roles, bulk role actions, staff management, leave-of-absence systems, verification, welcome messages, and counters.
• Community workflow systems, including tickets, reports, forums, dropdown panels, callouts, giveaways, reminders, AFK, custom forms, saved embeds, webhooks, quotes, and server invite embeds.
• Utility and roleplay features, including /ask, NPC systems, action/roleplay commands, games, and fun commands.
• Fictional economy gameplay, including virtual balances, fictional assets, businesses, services, stocks, companions, cooldowns, rob/heist commands, gambling-style minigames, leaderboards, black-economy themed commands, and the economy portal.
• Premium features, custom branding, custom prefixes, premium limits, dashboard or website-related tools, templates, and developer-operated maintenance systems.

The Service operates as a third-party application on Discord's platform and is subject to Discord's Terms of Service, Discord's Community Guidelines, and all applicable Discord Developer Terms in addition to these Terms.

02A Automation, Ask, and User Content

The Secretary processes user and administrator content only to provide the selected bot features. By using features that accept text, files, links, prompts, or configuration, you confirm that you have the right to provide that content and that it complies with Discord's rules and applicable law.

• /ask AI Utility - /ask responses are generated from user prompts. /ask is not used by us to train The Secretary. AI output may be inaccurate, fictional, offensive, incomplete, or unsuitable for high-stakes decisions.
• Administrator Configuration - Server administrators are responsible for the content they configure, including ticket panels, welcome messages, verification text, AutoMod rules, webhooks, embeds, dropdowns, forum questions, report flows, quote lists, and role panels.
• User Submissions - Users are responsible for content they submit through tickets, reports, forms, /ask prompts, NPC messages, economy names, quotes, and other interactive features.
• No Sensitive Data Submission - Users must not submit passwords, payment card details, private credentials, government IDs, medical records, or other sensitive personal information into bot commands, tickets, forms, /ask prompts, or server-configured workflows.
• Moderation Is Not Guaranteed - AutoMod, logs, blacklists, verification, and cleanup tools are provided to assist server staff. They do not guarantee full protection from spam, abuse, raids, illegal content, or rule-breaking behavior.

03 Eligibility and Account Responsibility

To use The Secretary, you must:

• Be at least 13 years of age, or the minimum age required in your jurisdiction to use Discord.
• Have a valid Discord account in good standing.
• Comply with Discord's Terms of Service at all times.

Server administrators who add the Bot to their server are responsible for ensuring that its use complies with these Terms and that their server members are aware of the Bot's presence and functionality.

You are responsible for all activity that occurs through your use of the Service. Do not share your server's administrative access with others in ways that could lead to misuse of the Bot.

04 Acceptable Use

You agree to use The Secretary only for lawful purposes and in a manner consistent with these Terms, Discord's policies, and all applicable laws and regulations.

Acceptable uses include:

• Configuring and using the Bot's features as documented for their intended purposes.
• Using reaction roles, giveaways, LOA systems, and form features within your Discord server for legitimate community management.
• Purchasing and using premium features as provided under an active subscription plan.
• Reporting bugs, errors, or abusive usage to our support team via official channels.

05 Prohibited Conduct

You expressly agree not to engage in any of the following:

• Exploitation - Exploiting bugs, race conditions, database errors, permission mistakes, cooldown bypasses, economy flaws, or unintended behavior in the Bot.
• Spam and Abuse - Using commands, aliases, webhooks, embeds, tickets, reports, /ask, NPCs, giveaways, forms, or role systems to spam, harass, threaten, impersonate, raid, or disrupt communities.
• Illegal or Harmful Content - Using the Bot to facilitate harassment, doxxing, fraud, malware, phishing, sexual exploitation, illegal content, hate, threats, evasion, or violations of Discord's policies.
• Sensitive Data Abuse - Requesting, collecting, posting, or storing passwords, private credentials, payment card data, government IDs, medical information, or other sensitive personal data through bot features.
• /ask Misuse - Using /ask to generate or distribute illegal instructions, targeted harassment, private-data extraction, impersonation, malware, scams, or content that violates Discord's rules.
• Circumvention - Attempting to bypass blacklists, premium restrictions, role restrictions, command restrictions, cooldowns, permission checks, or safety controls.
• Reverse Engineering - Attempting to reverse engineer, decompile, disassemble, scrape, clone, or derive the Bot's source code, private APIs, database structure, or internal systems without permission.
• Impersonation - Using Bot features to impersonate The Secretary team, developers, public figures, server staff, companies, or other entities in a misleading or harmful way.
• Webhook and Embed Misuse - Using webhook/editor/embed tools for scams, fake official notices, credential theft, malicious links, misleading giveaways, or deceptive impersonation.
• Real-Money Economy Trading - Buying, selling, trading, exchanging, brokering, wagering, or redeeming The Secretary economy currency, fictional assets, services, companions, accounts, or progression for real-world money, cryptocurrency, gift cards, goods, services, or anything of value.
• Misrepresentation of Economy Items - Claiming or presenting any economy item, asset, companion, business, balance, or store listing as an NFT, cryptocurrency asset, investment product, security, ownership certificate, redeemable commodity, or real-world property right.
• Automated Abuse - Using scripts, self-bots, macros, alternate accounts, or automated systems to farm economy rewards, spam commands, manipulate giveaways, bypass cooldowns, or overload the Service.
• Misuse of Admin Features - Server administrators must not use moderation, logging, ticket, verification, role, webhook, or cleanup tools to unlawfully target, deceive, exploit, or harm members.

Violations may result in warnings, command restrictions, data deletion, balance resets, economy account deletion, server blacklisting, user blacklisting, premium revocation, or other action without notice or refund.

06 Premium Services and Payments

The Secretary offers optional paid premium plans that unlock additional features. By purchasing a premium plan, you agree to the following:

• Activation — Premium plans require manual activation by a developer after payment is confirmed. Activation is typically completed within a few hours of payment through our support server.
• Billing Cycle — Plans are billed on a monthly basis. Subscriptions do not automatically renew; you must manually renew at the end of each billing period.
• Refund Policy — Due to the manual nature of activation, refunds are handled on a case-by-case basis. If the Bot fails to deliver premium features due to a service error, you may request a refund within 48 hours of activation through our support server.
• Revocation — Premium may be revoked without refund if you are found to be in violation of these Terms, including but not limited to exploitation of the Bot.
• Feature Changes — We reserve the right to modify, add, or remove features included in premium plans. Significant reductions in features will be communicated in advance.
• Expiration — Upon expiration of a premium plan, premium features will be automatically disabled. Server data will be retained but premium-exclusive configurations will revert to defaults.
• Donations — Voluntary donations do not entitle you to any specific service, features, or guarantees unless explicitly stated at the time of the donation.

07 Secretary Economy System

The Secretary Global Economy system, including the economy portal at thesecretary.xyz/economy, is a fictional gameplay system. It exists for entertainment, progression, roleplay, and playable bot interaction only. It is not a financial product, marketplace, exchange, gambling service, bank, investment platform, payment processor, or real-world commercial store.

• No Real-World Value — Economy currency, balances, assets, businesses, companions, services, stocks, shop items, achievements, cooldowns, and statistics are fictional gameplay data only. They cannot be redeemed, exchanged, sold, transferred, or claimed for real-world money, goods, services, cryptocurrency, gift cards, legal rights, or anything of value.
• No NFTs or Digital Ownership Claims — No item in the economy store, holdings display, companion system, or economy portal is an NFT. Economy items are not blockchain assets, tokenized property, collectible investments, ownership certificates, securities, or enforceable digital property rights.
• Store Discretion — Economy store items, prices, categories, images, rarity, availability, effects, descriptions, and ownership records are subject to developer discretion. We may modify, rebalance, restrict, remove, replace, reset, or discontinue any item or economy feature at any time, with or without notice.
• Account and Balance Discretion — By creating or using a Secretary Global Economy account, you agree that your fictional balances, assets, companions, businesses, services, cooldowns, unlocks, and progression may be adjusted, removed, reset, limited, or deleted at developer discretion for maintenance, abuse prevention, bug repair, balancing, moderation, legal compliance, or service changes.
• No Promotion of Gambling or Illegal Activity — Economy games, rob commands, heist commands, black economy naming, gambling-style minigames, fictional stores, and similar features are purely fictional gameplay mechanics. We do not promote, endorse, instruct, facilitate, or encourage real-world gambling, theft, fraud, money laundering, illegal trading, exploitation, or any unlawful activity.
• Images and Store Assets — Images used in economy stores, holdings, companions, and the economy portal are gimmick, decorative, illustrative, or generated visuals. We do not claim to own third-party assets, brands, products, likenesses, or intellectual property that may appear by reference, inspiration, parody, placeholder use, or coincidence.
• Companion Listings — Companion-related economy features do not represent or imply the sale, purchase, ownership, transfer, control, exploitation, or valuation of real human beings. Companion visuals may be AI-generated using tools such as ChatGPT, Gemini, or similar software. Any similarity to a real person, public figure, private individual, entity, brand, or work is unintentional and does not imply endorsement or affiliation.
• Portal Display — The economy portal is a visual depiction of fictional game assets and account state. Its displayed values, images, and listings are subject to all economy disclaimers in these Terms and our Privacy Policy.

08 Official Bot Identity

The only bots publicly claimed under The Secretary Group are The Secretary™ #7042 and Aiko Kuangatara #8262. No other Discord bot is publicly claimed by us unless expressly listed through our official website, support server, or developer-controlled channels.

Our official bots follow these Terms of Service and Privacy Policy. We are not responsible for third-party bots, copies, impersonators, clones, reuploads, forks, or services that claim association with The Secretary without authorization.

09 Intellectual Property

The Secretary bot, including its code, design, branding, and documentation, is the intellectual property of the Department of Artificial Intelligence, FAA. All rights are reserved.

You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license does not include any right to:

• Copy, reproduce, or distribute the Bot's code or assets.
• Create derivative works based on the Bot without express written permission.
• Use The Secretary's branding, logo, or name in any manner that implies endorsement or affiliation without permission.

Content submitted through the Bot's features (such as form responses or LOA reasons) remains the property of the respective authors. By submitting content through the Bot, you grant us a limited license to process and relay that content as necessary to operate the Service.

10 Service Availability and Modifications

We strive to maintain high availability of The Secretary, but we do not guarantee uninterrupted service. The Bot may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Discord platform outages, API changes, rate limits, permission changes, or intent restrictions
• Infrastructure, database, AI provider, chart provider, payment, or hosting issues outside of our control
• Security incidents requiring emergency response
• Feature rewrites, policy changes, abuse prevention, or legal compliance requirements

We may modify, limit, rebalance, suspend, rename, replace, or discontinue any feature, command, premium benefit, AI behavior, economy mechanic, stored configuration type, dashboard page, or integration at any time. We are not liable for loss of fictional economy data, configuration inconvenience, missed reminders, missed logs, missed moderation actions, AI output quality, or downtime caused by such changes.

For known maintenance windows or significant updates, we will endeavour to notify users through our official Discord support server.

11 Disclaimer of Warranties

The Secretary is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Guarantees that the Service will be uninterrupted, error-free, or completely secure.
• Warranties regarding the accuracy, reliability, or completeness of any outputs or features.

You use the Service entirely at your own risk. We do not warrant that any defects or errors in the Service will be corrected, or that the Service will meet your specific requirements.

12 Limitation of Liability

To the maximum extent permitted by applicable law, the operators of The Secretary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, server content, or configurations resulting from use of the Service.
• Loss, reset, adjustment, removal, deletion, or unavailability of fictional economy balances, assets, companions, businesses, services, cooldowns, items, or progression.
• Damage caused by reliance on any Bot feature or output.
• Any harm resulting from unauthorised access to your data or Discord server.
• Any disruption to your server's operations caused by the Bot or its features.

In no event shall our total cumulative liability to you exceed the amount you have paid for premium services in the three months preceding the claim, if any.

13 Termination and Suspension

We reserve the right to terminate or suspend your access to the Service at our sole discretion, without prior notice, if we reasonably believe you have violated these Terms or Discord's Terms of Service.

Grounds for termination or blacklisting include but are not limited to:

• Exploitation of the Bot's features or vulnerabilities
• Harassment of Bot developers or support staff
• Using the Bot to facilitate illegal activities
• Real-money trading, attempted real-money trading, or promotion of real-money trading involving fictional economy data
• Repeated violations of these Terms following warnings

If your server is blacklisted, The Secretary will leave your server and notify the server owner or inviter. You may appeal a blacklist decision by opening a ticket in our official support server. We reserve the right to deny appeals at our discretion.

You may also terminate your use of the Service at any time by removing The Secretary from your server. Removal of the Bot will cease all data processing for your server.

14 Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall first be attempted to be resolved informally through our support server. If informal resolution is not possible, disputes shall be resolved through appropriate legal channels.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

15 Changes to These Terms

We reserve the right to update or modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this document. Material changes may also be announced in our official Discord support server.

Your continued use of The Secretary after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and remove the Bot from your server.

We encourage you to review these Terms periodically to stay informed of any updates.
